Child Sexual Assaulter Faces Failure To Comply Charges After Vacations
CONCORD, NH — A child sexual assaulter is facing three felony charges after being accused of failing to tell police about trips he took and an active Facebook account.
David Paul Allen, 39, of Fisherville Road in Concord was arrested at 6:22 p.m. on May 3 on registration of online identifiers and two sex offender registration; knowing failure to comply charges, all felonies.
The investigation into the allegations dates back to March 7 when a Concord detective received a request from a paralegal at the New Hampshire Sex Offender Registry to see if Allen had informed police he would be traveling overseas. Air marshals had notified the state he was traveling while completing a compliance check. Allen, the report noted, was a registered sex offender due to an aggravated felonious sexual assault conviction of a victim under 13 out of Hillsborough County from March 2013 after an incident in Hudson in November 2008.
Allen, the detective wrote, had been released from the state prison in December 2022, filed paperwork with police at that time, and again on Feb. 22.
The detective said in their report it was common for international travelers to post photos from their vacations and began searching the social media site to see if Allen had an account. During the search, the detective found an account listing Allen’s employment, education, current city, relationship status, and a profile photo of himself, proving he had an active Facebook account not listed on his sex offender registration, an affidavit said.
The detective accused Allen of utilizing location tags on Facebook while traveling at various airports and posting pictures showing he was in Mexico for two weeks with his girlfriend in January.
When the detective checked his registration from February, he accused Allen of failing to notify the police of this temporary address, as required by sex offenders when they travel.
The report said the detective requested files from the feds as well as a copy of Allen’s passport and airline ticket information as part of the investigation. After doing so, the detective accused Allen of being on a cruise to Belize, Honduras, and Mexico, having left three days before on March 4 — but he did not inform police of those temporary address changes as required, an affidavit stated.
The detective requested a search warrant from Facebook for the account presumed to be Allen’s.
On March 23, the New Hampshire Joint Fugitive Task Force and the detective located Allen at his employment in Concord and interviewed him, a report said. He was accused of admitting to traveling and celebrating the completion of his sentence — saying he had not been on vacation for more than 15 years. While speaking with Allen, the detective accused him of admitting he did not report his travel plans despite being required to notify police if he would be outside the state for more than five days.
On April 25, Meta Platforms (Facebook) responded to the search warrant and connected Allen via his seized cellphone and number listed on his sex offender registration as being connected to the account, proving the account was his, an affidavit said. The folder, the detective added, contained 105 videos and photos. The file also had “check-ins” made by Allen at different locations during his travels, the report stated.
A warrant was then issued for his arrest on May 3.
According to the state, Allen was convicted in March 2013 on a single aggravated felonious sexual assault charge against a child in Hillsborough County Superior Court South. He was also convicted on a felony second-degree assault charge in November 2009 and a simple assault charge in May 2020.
Allen was released on bail on May 30. An arraignment in Merrimack County Superior Court, originally scheduled for June 1, was canceled.
